Retreat Terms and Conditions

These Terms & Conditions apply to all retreats, experiences and events operated by Mock Gravity Pty Ltd (33 114 483 251) trading as Nourish Travel (“Nourish Travel”, “we”, “us”, “our”).

By submitting a registration form and/or paying a deposit, you acknowledge that you have read, understood and agree to be bound by these Terms & Conditions.

1. BOOKINGS & PAYMENT

1.1 Reservation Request

All bookings are subject to availability and acceptance by Nourish Travel.

Nourish Travel reserves the right to decline or cancel bookings at our discretion.

A reservation is confirmed only upon:

  • Receipt of the required 50% deposit; and

  • Written confirmation issued by Nourish Travel.

1.2 Payment Schedule

The remaining balance is due no later than 60 days prior to the commencement of the retreat, unless otherwise agreed in writing.

Failure to make the final payment by the due date may result in cancellation of your booking without a refund of the deposit.

2. PRICING

All prices are quoted in AUD unless otherwise stated.

Prices are based on costs and exchange rates at the time of publication. Nourish Travel reserves the right to adjust pricing prior to booking confirmation.

3. CANCELLATION BY PARTICIPANT

All cancellations must be submitted in writing.

Cancellation fees are as follows:

  • More than 12 weeks prior to retreat start date:

    Deposit is non-refundable but may be transferred to another Nourish Travel retreat within the same or following calendar year, subject to availability.

  • 6–12 weeks prior:

    75% of total retreat fee is retained.

  • Less than 6 weeks prior:

    100% of total retreat fee is retained.

Cancellation fees represent a genuine pre-estimate of loss including non-recoverable accommodation, venue, supplier, staffing and administrative costs.

Nourish Travel strongly recommends comprehensive travel insurance to cover cancellation and unforeseen circumstances.

4. CANCELLATION OR CHANGES BY NOURISH TRAVEL

Nourish Travel reserves the right to cancel, postpone or modify a retreat where necessary due to:

  • Minimum participant numbers not being met

  • Safety concerns

  • Supplier failure

  • Government restrictions

  • Force majeure events

4.1 Force Majeure

Nourish Travel shall not be liable for failure to perform its obligations where such failure results from events beyond reasonable control including but not limited to:

Natural disasters, weather events, pandemics, border closures, airline disruptions, strikes, civil unrest, government action or political instability.

In such cases, Nourish Travel may offer a credit toward a future retreat. Refunds may be issued at Nourish Travel’s discretion after deduction of unrecoverable costs.

4.2 Organiser Cancellation

If Nourish Travel cancels a retreat for reasons other than force majeure, participants may be offered:

  • A transfer to another retreat; or

  • A refund of amounts paid, less unrecoverable third-party costs.

5. TRAVEL INSURANCE

Comprehensive travel insurance is strongly recommended and may be required for certain retreats.

Participants are responsible for ensuring their insurance policy covers:

  • Trip cancellation or interruption

  • Medical expenses

  • Emergency evacuation

  • Personal liability

  • Loss of personal belongings

Nourish Travel is not responsible for any participant’s failure to obtain appropriate coverage.

6. HEALTH & FITNESS

By booking, you confirm that you are physically and mentally fit to participate in the retreat.

You are responsible for:

  • Disclosing relevant medical conditions

  • Obtaining required vaccinations or travel documentation

  • Complying with local laws and health directives

Participation in retreat activities is voluntary.

All participants must sign the applicable Nourish Travel Participation Agreement and Injury Waiver prior to attendance.

7. PARTICIPANT CONDUCT

Nourish Travel is committed to providing a safe and respectful environment.

We reserve the right to remove any participant whose behaviour is:

  • Unsafe

  • Disruptive

  • Intoxicated

  • Unlawful

  • Detrimental to the experience of others

No refund will be provided in such circumstances.

8. THIRD-PARTY SUPPLIERS

Nourish Travel coordinates services provided by independent third parties including but not limited to:

  • Accommodation providers

  • Transport operators

  • Safari operators

  • Activity providers

  • Facilitators

Nourish Travel acts as an intermediary and is not liable for the acts or omissions of independent contractors.

Participants acknowledge that they may also be subject to the terms and conditions of third-party suppliers.

9. ITINERARY CHANGES

Retreat itineraries are subject to change.

Nourish Travel reserves the right to:

  • Substitute accommodation or facilitators

  • Alter activity schedules

  • Modify retreat inclusions

Where possible, reasonable alternatives will be provided.

10. MISSED DEPARTURES & TRANSFERS

Participants are responsible for arriving at the designated meeting point at the specified time.

Nourish Travel is not liable for:

  • Missed flights

  • Delayed arrivals

  • Missed transfers

Any additional costs incurred are the participant’s responsibility.

11. GOVERNMENT REGULATIONS & HEALTH DIRECTIVES

Participants acknowledge that government regulations, border controls, quarantine requirements or health directives may change at any time.

Participants are responsible for:

  • Monitoring travel advisories

  • Complying with all applicable laws

  • Bearing associated costs

12. LIMITATION OF LIABILITY

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy under the Competition and Consumer Act 2010 (Cth) or other applicable law that cannot be excluded.

To the extent permitted by law:

  • Nourish Travel’s liability for breach of any statutory guarantee is limited to the re-supply of services or payment of the cost of having services supplied again.

  • Nourish Travel’s total liability for any non-personal injury claim shall not exceed the total amount paid by the participant for the retreat.

Liability for personal injury is governed by the applicable Participation Agreement and Injury Waiver.

13. MEDIA RELEASE

Participants grant permission for photographs and video footage taken during the retreat to be used for marketing and promotional purposes unless written notice opting out is provided prior to retreat commencement.

14. PRIVACY

Personal information collected is used solely for retreat administration and communication.

Nourish Travel does not sell or trade personal information. Full privacy details are available upon request.

15. SEVERABILITY

If any provision of these Terms & Conditions is found unenforceable, the remaining provisions shall remain in full force and effect.

16. GOVERNING LAW

These Terms & Conditions are governed by the laws of New South Wales, Australia.
